Clause 2: The Employer’s Requirements

  1. Project ScopeThe Employer is desirous of carrying out a small refurbishment and extension at [Project Address]. The Works shall include, but are not limited to:

    • Internal refurbishment of existing structures, including mechanical and electrical upgrades.

    • Construction of a [Specify Size] sqm extension to the existing building.

    • Structural alterations where required to integrate the new extension with the existing building.

    • Upgrades to finishes, fixtures, and fittings as per the contract documents.

    • Any necessary external works, including drainage, paving, and landscaping.

  2. Contract and Obligations

    • The Works shall be executed under the terms of the RIAI Blue Form of Contract (With or Without Quantities) as applicable.

    • The Contractor shall ensure compliance with all Planning Permissions, Building Regulations, and Health & Safety requirements under Irish law.

    • The Works shall be completed within the agreed contract period of [Specify Duration] weeks from the commencement date.

  3. Quality and Standards

    • All materials and workmanship shall conform to Irish Building Regulations, current industry standards, and manufacturer specifications.

    • The Contractor shall engage competent subcontractors and specialists where required, subject to the Architect’s approval.

    • The Employer reserves the right to inspect and approve all works at key milestones before proceeding to subsequent stages.

  4. Contractor’s Responsibilities

    • The Contractor shall provide a programme of works detailing key activities, milestones, and completion dates.

    • The Contractor shall be responsible for site management, security, waste disposal, and maintaining a safe working environment.

    • Any deviations from the contract documents must be submitted for approval before execution.

  5. Payment & Retention

    • Payment shall be made in accordance with the agreed stage payments set out in the contract.

    • A retention percentage of [Specify %] shall be held for [Specify Retention Period] post-completion, subject to the resolution of defects.

  6. Defects and Completion

    • The Contractor shall be responsible for rectifying defects within the Defects Liability Period as per the contract.

  7. Insurance and Indemnity

    • The Contractor shall provide evidence of valid Public Liability Insurance, Employers’ Liability Insurance, and Contractors’ All Risks Insurance before commencing works.
